These Terms of Service (“Terms”) govern your access to and use of services provided by Superform Life, LLC(“Superform,” “we,” or “us”), including all websites, digital platforms, and in-person programs (collectively, the “Services”).
By purchasing, registering for, or participating in any Superform program, you agree to these Terms.
1. Scope of Services
Superform provides athletic performance, recovery, and wellness optimization programs that combine digital and in-person assessments, individualized training, and lifestyle guidance.
Superform is not a medical provider and does not practice medicine.
Any medical or diagnostic testing associated with a Superform program is performed solely by independent, licensed medical partners who maintain their own clinical oversight and HIPAA compliance. Superform’s role is limited to coordinating and delivering performance-based, non-medical services.
2. Eligibility
Participation is open only to individuals 18 years or older who have been medically cleared for high-intensity physical activity.
By enrolling, you represent that you meet these requirements and that all information you provide is accurate and complete.
3. Participant Responsibilities
Participants agree to:
Follow program protocols and safety instructions
Wear and maintain assigned wearable devices as directed
Complete required assessments and daily questionnaires
Provide accurate feedback and comply with scheduling and tracking requirements
Failure to meet participation obligations may limit personalization or result in suspension or removal without refund, consistent with the Superform Alpha Program Participant Agreement.
4. Relationship with Medical Partners
All laboratory tests, DEXA scans, or medical consultations are conducted by independent licensed medical partnersunder their own compliance programs.
Participants authorize those partners to share data (such as summary results, medical-clearance status, or program outcomes) with Superform for the sole purpose of designing and managing performance programs.
Superform does not access or maintain full medical records, nor does it diagnose, treat, or prescribe.
5. Fees and Payments
All program fees are displayed at checkout and are due in full at the time of registration or acceptance, unless otherwise specified in writing.
Payments are processed securely through third-party payment processors. Superform does not store full credit-card information.
Fees are non-refundable, except as stated in Section 6 or where otherwise required by law.
6. Refund Policy
All Superform program fees are non-refundable, consistent with the Participant Agreement.
Refunds will be provided only if:
Superform cancels a program before it begins; or
A refund is required under applicable consumer-protection law.
If a participant withdraws after the program begins, Superform may, at its discretion, issue a service credit for future use.
Once assessments or services have started, no cash refunds are available.
7. Scheduling and Delivery
Digital materials and onboarding content are distributed upon purchase.
In-person or remote assessments are typically scheduled within 7–14 business days, and personalized plans are delivered within 7-14 business days following baseline testing.
Delivery times may vary based on partner availability or participant readiness.
8. Assumption of Risk
Participation in any Superform program involves physical exertion, testing, and use of equipment that carry inherent risks, including but not limited to muscle soreness, strain, injury, cardiovascular events, metabolic disturbances, or equipment malfunction.
By enrolling, you voluntarily assume all such risks and release Superform Life, LLC, its officers, employees, contractors, affiliates, and partners from liability for injuries or damages arising from participation, except in cases of gross negligence or willful misconduct.
9. Intellectual Property
All Superform content, materials, logos, methods, and media are the property of Superform Life, LLC and may not be copied, shared, or distributed without written permission.
Participants receive a limited, non-transferable license to use provided materials solely for personal use during enrollment.
10. Privacy and Data Use
Superform collects and uses participant data as described in the Superform Privacy Policy available on our website.
Superform is not HIPAA-compliant, but all medical partners handling laboratory or diagnostic information are HIPAA-compliant.
Participants authorize those partners to share limited summary data with Superform for program delivery and progress tracking.
Superform safeguards all received information in accordance with applicable privacy and data-protection laws.
11. Media and Testimonials
With your consent, Superform may use photographs, video, written testimonials, or de-identified performance data for educational, research, or marketing purposes.
You may withdraw consent for future use at any time by contacting concierge@superformlife.com.
12. Limitation of Liability
To the fullest extent permitted by law, Superform shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of its Services.
Total liability for any claim shall not exceed the amount paid by the participant for the specific program giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Superform Life, LLC, its affiliates, employees, contractors, and medical partners from any claims, damages, or expenses arising out of:
(a) your participation in any program;
(b) your breach of these Terms; or
(c) injury or harm to others caused by your actions or omissions.
This obligation survives termination of participation.
14. Termination and Modification
Superform may suspend, modify, or cancel any program or Service at its discretion, including for participant non-compliance or events beyond Superform’s reasonable control (e.g., facility closures, public-health restrictions).
Such changes do not entitle participants to refunds, though Superform may, in its discretion, offer schedule adjustments or service credits.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute shall first be subject to good-faith negotiation.
If unresolved, it shall be submitted to binding arbitration in Los Angeles County, California, administered by the American Arbitration Association.
Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Each party shall bear its own attorneys’ fees and costs unless otherwise required by law.
16. Changes to Terms
Superform may revise these Terms periodically. Updated versions will be posted on our website with a revised “Last Updated” date. Continued use of the Services constitutes acceptance of the revised Terms.
